Immigration attorneys advised H-1B employees at Microsoft, Adobe and other named tech companies to seek counsel about their status after the Trump administration announced Thursday that it was suspending the companies from a federal visa sponsorship program.
The suspensions concern Permanent Labor Certification, or PERM, a step employers generally must complete before sponsoring a worker for an employment-based visa. Employers must show that no qualified, available U.S. workers can fill the role.
The attorneys said individual circumstances matter. Some said the suspensions were likely to face court challenges; one suggested they would affect a relatively small group of workers.
Vice President JD Vance accused Microsoft of using the system to hire lower-paid foreign workers after laying off U.S. employees. His claim was presented as an allegation, not an established finding.
