Mahmoud Khalil has asked the Supreme Court to allow federal judges to promptly review the legality of immigration detentions, rather than wait for immigration courts to finish each case.
His filing seeks to overturn a ruling by the 3rd U.S. Circuit Court of Appeals that bars federal court review until immigration proceedings are complete. The appeals court has paused that ruling while Khalil seeks Supreme Court review; he remains free.
Khalil, a lawful permanent resident and former Columbia University graduate student, was detained last year over his participation in pro-Palestinian demonstrations at the university in spring 2024. The federal government argued that his presence harmed U.S. foreign policy interests. He spent more than three months in detention before a federal judge in New Jersey ordered his release, finding that the government had acted unconstitutionally.
