A college student died after she and another student were given fentanyl in a Manhattan residence hall in March, federal prosecutors said. The second student survived. Prosecutors allege one of the women was raped while she was unconscious.
Court documents identify the women as students at the Fashion Institute of Technology. Prosecutors have not named them. Two men, Moises Freire, 19, of the Bronx, and Brian Peralta Cabrera, 18, of Queens, were arrested and indicted; both pleaded not guilty.
According to the indictment, Freire told one student the drug was cocaine and did not contain fentanyl, though prosecutors allege he knew it was fentanyl. The indictment says he urged both women to take it and they lost consciousness. Prosecutors allege Freire then raped one woman and waited about 45 minutes before calling campus security.
Freire faces charges including distributing a controlled substance with intent to commit rape and distributing narcotics resulting in death. Cabrera faces a conspiracy charge involving distribution of narcotics resulting in death and serious bodily injury.
